This seminar highlights the operation and execution of the NRS 458A process. This obscure Nevada law sets forth the pathway to court-ordered diversion programs for criminal defendants charged with non-violent offenses when there is a sufficient nexus between a diagnosed problem gambling disorder and the offense committed. Special emphasis is placed on evaluation criteria, evidentiary standards for judicial assessment, the role of diagnosis and treatment plans, and the practical considerations for the statutory application, including potential dismissal of action.

Learning Objectives

By the end of this presentation, participants will:

  1. A working familiarity with DSM-5-TR Diagnostic Criteria for Gambling Disorder and the ability to discuss the same with non-medical advocates for a client.

  2. Understanding of the sorts of forensic evidence available to assist both diagnosis and application for NRS 458A diversion treatment.

  3. Practical considerations (and challenges) for presentation of a potential 458A eligible defendant to a court-ordered diversion program.

  4. Knowledge of staffing and supervision protocols for both Clark County’s Gambling Treatment Diversion Court or individually designed programs under NRS 458A.260.

  5. Appreciation of the pathway (and possible barriers) to a successful “graduation” from Diversion programs and the benefits that follow.
