This is a two part Confidentiality and HIPAA course totaling 6 CEUs. Participants can attended either or both sessions on 11/3 and 11/10.

Confidentiality, 42 CFR part 2 & HIPAA: This workshop will be a 2-part series with each session being 3 hours.  It will cover Federal and Nevada regulations related to confidentiality with an emphasis on practical solutions to real problems. Topics will include: proper consent for release of information, how to respond to a subpoena, exceptions to the general rule for releasing information, as well as child and elder abuse reporting requirements. Additionally, a guide to duty to warn within the required regulations will also be provided. Conflicts between Federal and State laws will be explored with guidance on how to resolve these differences. Case studies will be utilized to enhance the learning experience. (Confidentiality and HIPAA for continued education is required for interns as well as for licensed or certified counselors who are renewing their license or certificate.)  

Learning Objectives

By the end of this presentation, participants will:

  • Identify and apply key Federal and Nevada regulations related to client confidentiality, including updates to the Part 2 Final Rule.

  • Demonstrate appropriate responses to legal requests for information, such as subpoenas, and understand the requirements for a valid consent, mandatory reporting, and duty to warn.

  • Analyze potential conflicts between Federal and Nevada confidentiality laws and apply practical strategies for resolving these differences in a clinical or counseling setting.
